Although workers’ compensation covers many workers, it does not cover all workers. There are exceptions to who must be provided workers’ compensation under the law. In fact, Texas is the only state in which employers do not have to purchase workers’ compensation insurance to cover their workers. If you were hurt in Texas while working, then there’s a real chance that you don’t even have the option to file a workers’ compensation claim.

In Louisiana and the other states, the following people might not get workers’ comp coverage:

  • Independent contractors
  • Workers at companies with a small number of employees
  • Workers who intentionally tried to get hurt at work
  • Workers with certain pre-existing conditions

Should You Have Workers’ Compensation in Texas?

Texas doesn’t require employers to cover their workers with workers’ compensation benefits. However, many employers in Texas opt to buy workers’ comp insurance because it protects them and their company from liability if a workplace accident happens. Otherwise, an employer can be sued directly by an injured worker if the employer’s negligence contributed to the accident.
