CONSTRUCTION INJURY ATTORNEYS

Legal Allies for Injured Construction Workers

Construction accidents are prevalent enough to routinely make the Occupational Safety and Health Administration (OSHA) top list of most common workplace accidents. But that doesn’t mean that construction accidents are not preventable, nor does it mean that you cannot take legal action if you are hurt in one.

Morris & Dewett Injury Lawyers can help you understand your rights to compensation if you have been hurt while working on a construction site. Our Fort Worth construction accident attorneys have years of collective experience that can give them the edge over the competition in your claim. If there is any resistance to your case, we will be ready to push right back!

OSHA Fatal Four

According to OSHA, the four most common causes of death in construction sites are:
  • Falls from heights:
Workers positioned toward the top of a construction site or who are using scaffolding are at an increased risk of a fatal fall.
  • Struck-by-object accidents:
Falling objects like tools and debris can fatally strike anyone below, even if they are wearing a hardhat.
  • Caught-in/between accidents:
Hundreds of construction workers each year are severely injured or killed after being caught inside a piece of machinery or between two construction vehicles or moving objects.
  • Electrocutions:
Electrical accidents on construction sites are the final of OSHA’s “Fatal Four.” Electrocutions mostly affect electricians, but some electrical accidents strike workers who were in the wrong place at the wrong time.
Our law firm is capable of handling any construction accident claim, whether it involves one of the OSHA Fatal Four or not. Please give us a call at (318) 221-1508 if you were hurt while working on a construction site or if you were just passing through when tragedy struck.

Personal Injury or Workers’ Compensation?

After a construction accident leaves you injured, you might be wondering how you can pursue compensation. Would it be right to pursue a personal injury claim or a workers’ compensation claim? It depends on what led up to your accident and your employment categorization.

To figure out which option works for you, we will have some questions to consider:

  • If you are an employee, then you might be covered by workers’ compensation insurance. Texas is the only state that does not require employers to purchase workers’ comp for their employees, but many do all the same because they want to avoid being personally accountable if negligence causes an on-the-job accident. Our attorneys can review your case and employment status to see if you have workers’ comp, which can be used to give you certain benefits regardless of liability.
  • If you are not an employee but are an independent contractor, then you most likely don’t have workers’ compensation coverage. You will have to sue your employer through a civil injury claim and prove that negligence that they allowed caused your accident, which means you cannot have caused it, either. This is also the route you will need to take if you are an employee, but your employer opted to not buy workers’ compensation insurance as is allowed in Texas.
